RESOLUTION NUMBER: 2006-8

A RESOLUTION AUTHORIZING THE TRANSFER OF ASSETS TO THE DISTRICT

WHEREAS, the District was incorporated as a water and sewer district under the provisions of Title 7,

Chapter 13, parts 22 and 23 M.C.A.; and

WHEREAS, the District’s primary purpose is owning, operating, maintaining and improving the water

and sewer systems serving the District’s residents; and

WHEREAS, the assets of the water and sewer systems are currently owned by the Sunny Meadows

Homeowners Association and various individual homeowners; and

WHEREAS, the District needs to fully own and control the water and sewer systems in order to be

eligible for grant and/or loan funding for related projects; and

WHEREAS, the District believes that this is in the best interests of its residents that it fully own,

operate, manage, and maintain the water and sewer systems serving the residents of the District.

THEREFORE BE IT RESOLVED, that the District authorizes and directs the board of directors to

perform all actions necessary to transfer ownership and rights unto any assets associated with the water

and sewer systems currently serving District residents from the current holders of those assets, to the

District.
