October 5, 2016 06:00 PM at Bonner Lutheran Church 

 

Roll Call: Dusty Deschamps, Barb Powell, Kari Wafstet, Paula NIccum. 

 

Approval of Minutes: A motion to approve minutes as posted and amended on website was made by Kari, seconded by Barb.  Motion carried, minutes approved. 

 

Financial Information:  Financial reports finally received by the county for June.  They agreed with the preliminary financials prepared by Barb.  Motion made by Kari to approve, seconded by Paula.  Motion carried, financials approved. 

 

Public Input: None. 

 

Old Business: A resolution was discussed to compensate water board members according to attendance at meetings during fiscal year 2015-16.  Motion made by Paula, seconded by Kari.  Motion carried.  Claims submitted to Cyndie. 

Discussion of a proposed ordinance ammendment to Article 2, section 12 regarding NSF checks.   

 

Proposed amendment to Article II, adding Section 12: 

 

12. Payment not honored. In the event that a customer presents a payment to the district which is subsequently determined to not be valid, such as a non-sufficient funds check, fraudulent check, or check on which payment has been stopped, the District must attempt to recoup all costs and expenses associated therewith. 

1.   The District will assess a service charge in the greater of the actual cost to the District, or the maximum amount allowed by Montana law (see M.C.A 27-1-717 subsection (2)). In 2016, this maximum is set at $30 per occurrence. 

2.  The amount of the returned payment will be marked as unpaid, and subject to late fees and interest from the original due date. 

3.   If full payment of the returned payment and any associated fees is not received within 30 days, the customer’s account will immediately be considered delinquent, and subject to immediate disconnection. 

4.    The District may pursue any legal option to collect the outstanding of the balance on the account. These options include: 

o Using M.C.A. 27-1-717 subsection (3) to sue in civil court. 

o Collect the balance of the account on the customer’s tax bill per M.C.A. 7-13-2301. 

o Seeking criminal prosecution for Issuing a Bad Check per M.C.A. 45-6-316. 

  

Amendment will be discussed at meetings on 11-2-2016, 12-7-2016  & 1-4-2017 water board meetings and then vote will take place. 

 

New Business:  A question was asked about adding a charge for repeat offenders in arrears 60-90 days more tha once in a fiscal year.   

Discussion of Bac-t hits.  Cyndie submitted documentation from Brian for services rendered.  More discussion at next meeting. 

Abuhl’s meter needs replacing.  *Cyndie checked the Abuhl’s meter prior to the meeting, but was unable to attend to report.  Wires were loose, meter is fine.
