{"id":16440,"date":"2015-09-02T13:27:53","date_gmt":"2015-09-02T20:27:53","guid":{"rendered":"https:\/\/www.sunnymeadowswater.com\/?p=16440"},"modified":"2015-09-02T13:27:53","modified_gmt":"2015-09-02T20:27:53","slug":"resolution-2015-06-niccum-appointment","status":"publish","type":"post","link":"https:\/\/www.sunnymeadowswater.com\/?p=16440","title":{"rendered":"Resolution 2015-06 Niccum Appointment"},"content":{"rendered":"<div class=\"resolution-display\">\n<h1>A RESOLUTION\u00a0TO APPOINT A REPLACEMENT DIRECTOR<\/h1>\n<p style=\"text-transform: uppercase;\"><strong>BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE Sunny Meadows Missoula County Water and Sewer District:<\/strong><\/p>\n<p><span style=\"font-weight: bold;\">WHEREAS,<\/span> the District was incorporated as a water and sewer district under the provisions of Title 7, Chapter 13, parts 22 and 23 M.C.A; and<\/p>\n<p><span style=\"font-weight: bold;\">WHEREAS,<\/span>\u00a0the District has 3 positions for four year terms open for the 2015 District Election to be held November 3rd, 2015; and<\/p>\n<p><span style=\"font-weight: bold;\">WHEREAS,<\/span><span style=\"font-size: 12.1599998474121px; line-height: 15.8079996109009px;\">\u00a0<\/span><span style=\"font-size: 12.1599998474121px; line-height: 15.8079996109009px;\">the District\u00a0received three valid nominating petitions for those open positions; and<\/span><\/p>\n<p><span style=\"font-weight: bold;\">WHEREAS,<\/span><span style=\"font-size: 12.1599998474121px; line-height: 15.8079996109009px;\">\u00a0pursuant to MCA 7-13-2262 (1) states &#8220;If the number of candidates is equal to or less than the number of positions to be elected, the election administrator may cancel the election in accordance with 13-1-304. If an election is not held, the board of directors shall declare elected by acclamation the candidate who filed a nominating petition for the position;&#8221; and\u00a0<\/span><\/p>\n<p><span style=\"font-size: 12.1599998474121px; line-height: 15.8079996109009px;\"><span style=\"font-weight: bold;\">WHEREAS,<\/span><span style=\"font-size: 12.1599998474121px; line-height: 15.8079996109009px;\">\u00a0pursuant to MCA 7-13-2262 (3) and (4), any vacancy on the board must be filled by the remaining directors; and<\/span><\/span><\/p>\n<p><span style=\"font-size: 12.1599998474121px; line-height: 15.8079996109009px;\"><span style=\"font-weight: bold;\">WHEREAS,<\/span><span style=\"font-size: 12.1599998474121px; line-height: 15.8079996109009px;\">\u00a0<\/span><span style=\"font-size: 12.1599998474121px; line-height: 15.8079996109009px;\">the District\u00a0received notice that the nominating petition for Paula S. Niccum is valid.<\/span><\/span><\/p>\n<p><span style=\"font-weight: bold;\">THEREFORE BE IT RESOLVED,<\/span> that the District declare that Paula S.
