{"id":16118,"date":"2006-10-05T18:30:00","date_gmt":"2006-10-06T01:30:00","guid":{"rendered":"https:\/\/www.sunnymeadowswater.com\/?p=16118"},"modified":"2006-10-05T18:30:00","modified_gmt":"2006-10-06T01:30:00","slug":"minutes-2006-10-051","status":"publish","type":"post","link":"https:\/\/www.sunnymeadowswater.com\/?p=16118","title":{"rendered":"Minutes 2006-10-05#1"},"content":{"rendered":"<h4>A Public Hearing \u00a0for Sunny \u00a0Meadows Missoula \u00a0County \u00a0Water and Sewer District<\/h4>\n<h4>Bonner School Library<\/h4>\n<h4>October 5, 2006<\/h4>\n<h4>Board Members Present: \u00a0Bill Engelstad , Mike Huber, Mike Lilley, Tom \u00a0Walter, and Cyndie Winchell<\/h4>\n<h4>Guests: \u00a0Kevin Cook, Tony \u00a0Niccum, Paula \u00a0Niccum, and clerk\/secretary, Joan Kuehn<\/h4>\n<div>President Mike Lilley \u00a0called \u00a0the hearing \u00a0to \u00a0order at 7:30 \u00a0P.M.<\/div>\n<div>\u00a0<\/div>\n<div>Tonight was the second \u00a0reading \u00a0of \u00a0three proposed \u00a0ordinances.<\/div>\n<div>1. Water Use Ordinance: Joan \u00a0read \u00a0aloud<\/div>\n<div>2. Water Rate Ordinance: Joan \u00a0read \u00a0aloud<\/div>\n<div>3. Sewer Use Ordinance: Mike read \u00a0aloud<\/div>\n<div>4. Each \u00a0ordinance must have three readings and \u00a0a public vote.<\/div>\n<div>5. Tony \u00a0and \u00a0Paula Niccum came well\u00adprepared \u00a0with \u00a0questions and \u00a0suggestions for edit changes including:<\/div>\n<div style=\"padding-left: 30px;\">a) Article II, Section \u00a04\u00a0<\/div>\n<div style=\"padding-left: 60px;\">i) add \u00a0\u201cfrom the district\u201d to \u00a0explain \u00a0who \u00a0issues the written \u00a0permit<\/div>\n<div style=\"padding-left: 30px;\">b) The billing \u00a0cycle has 4 \u00a0and \u00a05\u00adweek \u00a0months that were explained \u00a0as unavoidable.<\/div>\n<div style=\"padding-left: 30px;\">c) Many \u00a0typographical errors such \u00a0as Artcle II, Section \u00a08, \u201cof\u201d vs. \u201cor\u201d were noted \u00a0and \u00a0already \u00a0contained \u00a0in \u00a0a list<\/div>\n<div style=\"padding-left: 60px;\">for revision \u00a0from the August meeting.<\/div>\n<div style=\"padding-left: 30px;\">d) Ordinance 2, Article II, Section \u00a08<\/div>\n<div style=\"padding-left: 60px;\">i) The re\u00adconnect wording \u00a0seems \u201chard \u00a0and \u00a0cold\u201d to \u00a0Tony \u00a0with \u00a0no \u00a0accommodation \u00a0for a payment system.<\/div>\n<div style=\"padding-left: 90px;\">(1) By \u00a0the time this ever happens to \u00a0a homeowner, there have been \u00a0three (3) \u00a0notices of \u00a0non\u00adpayment. The<\/div>\n<div style=\"padding-left: 120px;\">first is a gentle reminder. Board \u00a0members assured \u00a0that within \u00a0the first 90\u00adday \u00a0window, there is room to<\/div>\n<div style=\"padding-left: 120px;\">work \u00a0with \u00a0homeowners.<\/div>\n<div style=\"padding-left: 30px;\">e) Section \u00a010<\/div>\n<div style=\"padding-left: 60px;\">i) Discussion \u00a0about the wording \u00a0upon \u00a0receipt vs. post\u00admarked \u00a0was considered. Receipt will be defined \u00a0as the<\/div>\n<div style=\"padding-left: 90px;\">date of \u00a0postmarking, just as April taxes are counted.<\/div>\n<div style=\"padding-left: 30px;\">f) Ordinance 3, Section \u00a01, item d<\/div>\n<div style=\"padding-left: 60px;\">i) This was a cut and \u00a0paste typo \u00a0to \u00a0be stricken.<\/div>\n<div style=\"padding-left: 30px;\">g) Article IV, Section \u00a01\u00a0<\/div>\n<div style=\"padding-left: 60px;\">i) Call it a water and \u00a0sewer district.<\/div>\n<div>6. Bill announced \u00a0the the SMHOA drainfield \u00a0has a 6000 \u00a0gallon \u00a0tank \u00a0that was pumped \u00a0two \u00a0years ago \u00a0and \u00a0will be again<\/div>\n<div style=\"padding-left: 30px;\">this spring. Sweet Pea was contracted \u00a0last time. There was an \u00a0eighteen\u00adinch \u00a0crust then. In \u00a0the spring, a water truck<\/div>\n<div style=\"padding-left: 30px;\">to \u00a0clean \u00a0and \u00a0flush \u00a0the pump \u00a0and \u00a0all sediment out will be arranged.<\/div>\n<div>7. WE have two \u00a0drain \u00a0fields with \u00a0only \u00a0one side working \u00a0right now. It is supposed \u00a0to \u00a0switch \u00a0over. Tony \u00a0sat with \u00a0an<\/div>\n<div style=\"padding-left: 30px;\">electrician \u00a0about ten \u00a0years ago. The system was broken \u00a0then.<\/div>\n<div>8. Bill repaired \u00a0one pump. The pump \u00a0was phase three, but it required \u00a0a converter. Tony \u00a0will look \u00a0for the switch \u00a0with<\/div>\n<div style=\"padding-left: 30px;\">Bill.<\/div>\n<div>9. Paula noted \u00a0that I Ordinance #2, a complete sentence would \u00a0improve reading \u00a0the document. Wording \u00a0about post-<\/div>\n<div style=\"padding-left: 30px;\">marked \u00a0dates and \u00a0past due being \u00a030 \u00a0days from the date of \u00a0the statement were adjusted.<\/div>\n<div>\n<hr class=\"system-pagebreak\" \/>10. Lengthy \u00a0discussion \u00a0between \u00a0Tony, Paula, Mike, Tom and \u00a0Bill examined \u00a0reading \u00a0meters on \u00a0a specific day, 6 \u00a0extra<\/div>\n<div style=\"padding-left: 30px;\">days being \u00a0potentially \u00a0added \u00a0to \u00a0some month\u2019s bill, the adverse expenses, and \u00a0the need \u00a0to \u00a0keep \u00a0rates as low as<\/div>\n<div style=\"padding-left: 30px;\">possible. The wording \u00a0of \u00a0\u201cconsidered \u00a0past due on \u00a0the 25th of \u00a0the next month\u201d will change to \u00a0\u201c30 \u00a0days after the date<\/div>\n<div style=\"padding-left: 30px;\">of \u00a0issue.\u201d<\/div>\n<div>11. Cyndie expressed \u00a0concern \u00a0that the current late fees do \u00a0not act as a deterrent for a couple of \u00a0habitually \u00a0late\u00adpaying<\/div>\n<div style=\"padding-left: 30px;\">families. The rate is $10. This amount may \u00a0be low when \u00a0factoring \u00a0in \u00a0Josie\u2019s calculating \u00a0time and \u00a0the cost of<\/div>\n<div style=\"padding-left: 30px;\">certified \u00a0letters. There was lots of \u00a0discussion \u00a0about being \u00a0draconian \u00a0vs. habitual payers at 120 \u00a0days. Following<\/div>\n<div style=\"padding-left: 30px;\">current policy \u00a0will continue. Late rates can \u00a0rise to \u00a0a $25 \u00a0fee for repeat offenders.<\/div>\n<div>12. The hope is to \u00a0hold \u00a0rates down \u00a0for a LONG time. The board \u00a0can \u00a0raise rates up \u00a0to \u00a03% \u00a0annually, as needed, after the<\/div>\n<div style=\"padding-left: 30px;\">one vote for these ordinances. A simple notice is all that is required. Kevin \u00a0noted \u00a0the cost of \u00a0$65 \u00a0per hour for a<\/div>\n<div style=\"padding-left: 30px;\">plumber may \u00a0rise in \u00a0the 20 \u00a0years ahead. Kevin \u00a0also \u00a0asked \u00a0if \u00a0others not paying \u00a0into \u00a0our water district are depending<\/div>\n<div style=\"padding-left: 30px;\">on \u00a0the established \u00a0fire hydrants. Rural fire would, it was thought, access water in \u00a0case of \u00a0fire in \u00a0an \u00a0emergency.<\/div>\n<div>13. There are ten \u00a0(10) \u00a0water rights still outstanding. We cannot absorb \u00a0these rights until there is an \u00a0upgrade of \u00a0the<\/div>\n<div style=\"padding-left: 30px;\">system.<\/div>\n<div>14. Tony \u00a0asked \u00a0about how well the water system provided \u00a0for everyone this summer. There were four times it was out.<\/div>\n<div style=\"padding-left: 30px;\">Twice were from over\u00aduse, and \u00a0re\u00adinstigating \u00a0watering \u00a0days solved \u00a0this. Twice were because of \u00a0mechanical issues.<\/div>\n<div style=\"padding-left: 30px;\">Comments came that four\u00adhour restrictions were too \u00a0challenging \u00a0for homeowners using \u00a0non\u00adautomated \u00a0sprinklers.<\/div>\n<div style=\"padding-left: 30px;\">Next year odd \u00a0\/ even \u00a0days will stay \u00a0in \u00a0place without hourly \u00a0rules.<\/div>\n<div>15. Tom asked \u00a0about our leakage. Statistics show our loss is a tolerable, accepted \u00a0range of \u00a0about 12%. The pump \u00a0house<\/div>\n<div style=\"padding-left: 30px;\">grass and \u00a0fire hydrants are not metered.<\/div>\n<div>16. Tom asked \u00a0if \u00a0wording \u00a0of \u00a0shall vs. should\/may \u00a0shut off \u00a0would \u00a0strengthen \u00a0one passage. It was decided \u00a0to \u00a0not lock \u00a0into<\/div>\n<div style=\"padding-left: 30px;\">forcing \u00a0shut\u00adoff \u00a0in \u00a0a set amount of \u00a0days.<\/div>\n<div>17. Cyndie asked \u00a0about the district buying \u00a0meters. The loan \u00a0application \u00a0is strengthened \u00a0for conserving \u00a0water and \u00a0there is<\/div>\n<div style=\"padding-left: 30px;\">a chance the district will reimburse those who \u00a0paid \u00a0for meters if \u00a0the loans are approved.<\/div>\n<div>18. The Department of \u00a0Natural Resources and \u00a0Conservation \u00a0(DNRC) \u00a0met and \u00a0ranked \u00a0applications last month. Our<\/div>\n<div style=\"padding-left: 30px;\">letters, calls and \u00a0participation \u00a0in \u00a0the legislative process to \u00a0support this application \u00a0will impact the result.
